Terms of Service

1. Acceptance

By registering for or using Netway ("the Service"), you agree to these Terms of Service ("Terms"). If you are using Netway on behalf of a company or organisation, you represent that you have the authority to bind that entity to these Terms.

2. The Service

Netway provides AWS egress cost analysis by deploying software into your AWS account via CloudFormation. You are responsible for your AWS account and any costs incurred within it. Basavytix is not responsible for AWS charges resulting from the CloudFormation stack deployment or associated resources.

3. Accounts

You must provide accurate and complete registration information. You are responsible for keeping your Netway API key confidential and for all activity that occurs under your account. Notify us immediately at support@basavytix.com if you believe your API key has been compromised.

4. Acceptable Use

You may not use Netway to:

• Violate any applicable law or regulation
• Attempt to access systems or data you are not authorised to access
• Reverse-engineer, decompile, or disassemble the Service
• Resell or sublicense the Service without prior written permission from Basavytix
• Interfere with or disrupt the integrity or performance of the Service

5. Subscription and Payment

Netway is offered on a subscription basis. Fees are invoiced in advance for each billing period (monthly or annual) and are payable by bank wire transfer within 15 days of invoice date. Subscriptions renew automatically unless cancelled before the renewal date.

Basavytix reserves the right to change pricing with 30 days' written notice to registered users. Price changes do not apply to the current paid billing period.

6. Trial Period

New accounts receive a 14-day free trial with full access to all features. No payment is required to start a trial. At the end of the trial period, continued use of the Service requires a paid subscription. Basavytix may terminate trial accounts that show no activity during the trial period.

6a. Refund Policy

Because Netway provides a 14-day free trial before any payment is required, all fees paid are non-refundable once a billing period has commenced.

Annual subscriptions: Customers who cancel an annual subscription within 30 days of their renewal date may request a prorated refund for unused complete months remaining in the billing period. Refund requests must be submitted to support@basavytix.com within 30 days of the renewal date.

Monthly subscriptions: No refunds are issued for partially used monthly billing periods.

Refunds, where applicable, are returned via bank wire transfer to the originating account within 14 business days of approval.

7. Termination

You may cancel your subscription at any time by emailing support@basavytix.com or by deleting the Netway CloudFormation stack from your AWS account. Basavytix may suspend or terminate your access for violations of these Terms, non-payment, or abuse of the Service.

Data deletion after termination: Following cancellation or termination of your account for any reason, Basavytix will permanently delete all your account data — including scan findings, topology snapshots, compliance history, and personal information — within 30 days of the termination date. You may export your data via the dashboard during this 30-day window. After deletion, your data cannot be recovered.

You may also request immediate deletion of your account and all associated data at any time by emailing support@basavytix.com. Deletion will be completed within 30 days of your request.

8. Data

You retain full ownership of all data in your AWS account. You grant Basavytix a limited, non-exclusive licence to process findings data solely for the purpose of delivering the Service. Our handling of your data is described in the Privacy Policy.

Active account retention: While your account is active, Netway retains scan findings, topology data, and compliance history for up to 365 days from collection. Data older than 365 days is automatically purged. This retention period supports annual PCI-DSS and SOC2 audit evidence requirements.

Post-termination retention: See Section 7 above. All data is permanently deleted within 30 days of account termination or upon request, whichever is sooner.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. Basavytix does not warrant that the Service will be uninterrupted, error-free, or that savings estimates will be achieved. Estimated savings are projections based on standard AWS pricing and actual results may vary.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Basavytix's total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the total fees you paid to Basavytix in the three months immediately preceding the claim.

Basavytix shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunity.

11. Governing Law

These Terms are governed by the laws of India (Karnataka), without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Bengaluru, Karnataka, India.

12. Changes

Basavytix may update these Terms from time to time. We will provide at least 14 days' notice of material changes by posting an update to this page and notifying registered users by email. Continued use of the Service after notice constitutes your acceptance of the updated Terms.
